Increasingly, disputes are resolved by parties through mediation and arbitration rather than trial. Two of our trial attorneys, each with more than 25 years’ of courtroom experience, also work in the area of alternative dispute resolution.
Belinda de Kozan, a partner in our firm, is certified by the Florida Supreme Court in Circuit Civil Mediation. Belinda’s litigation and trial experience, spanning more than a quarter century, includes successfully handling disputes in the following areas: serious personal injury/wrongful death (automobile, aviation, trucking, commercial accidents, and nursing home matters); insurance litigation; business litigation; construction litigation; condominium association claims; hurricane claims; guardianship and probate litigation. Belinda’s broad range of litigation experience makes her uniquely qualified to mediate cases in a wide array of disputes. A mediator’s working knowledge of the substantive law is a valuable asset to the parties seeking to resolve their disputes at mediation. In that regard, Belinda brings to the table an understanding of substantive law in many different areas of practice. She has mediated hundreds of cases as both an attorney and mediator, and has lectured on mediation topics. As a seasoned trial attorney, Belinda understands the benefits of resolution through mediation rather than protracted litigation and trial and enjoys helping attorneys and their clients resolve disputes through mediation in an informal, effective, and efficient manner.
Ed Fleming, a founding partner in our firm, has been involved in numerous construction arbitrations, both as an attorney, as well as an arbitrator. Ed is familiar with State and Federal statutes and rules governing the conduct and enforcement of arbitration awards, and he is a frequent lecturer on construction law issues. Ed has been certified as an approved instructor by State construction regulators and State bar associations, in several states.
Our beautiful downtown Pensacola offices boast ample, comfortable conference space for multi-party mediation. Belinda is available to travel to conduct mediations throughout Florida, and frequently is requested to serve as mediator across the panhandle of Florida in Okaloosa, Walton, and Bay counties, in addition to those near our offices in Escambia and Santa Rosa Counties.
